Terms of Service

1. Services

Webitt Digital provides the following services:

• Website Design & Development
• Web Strategy & Consulting
• Search Engine Optimization (SEO)
• Digital Marketing
• Website Hosting (optional add-on)

The specific scope of work for each engagement is outlined in a project proposal agreed upon by both parties before work begins.

2. Payment Terms

2.1 Deposit

All projects require a 50% deposit before work commences. This deposit covers initial work including research, planning, and design, and is non-refundable once work has begun.

2.2 Final Payment

The remaining 50% is due upon project completion and prior to the site going live or final files being delivered. The website will not be launched or transferred until full payment is received.

2.3 Payment Plans

For projects above a certain cost threshold, a payment plan for the remaining 50% may be available at Webitt Digital's discretion. Payment plan terms will be agreed upon in writing before work begins. Failure to meet installments will result in the project being paused until payments are brought up to date.

2.4 Accepted Payment Methods

• Bank Transfer (local and international)
• PayPal
• Credit / Debit Card

All prices are quoted in the currency specified in your project proposal. International clients may be subject to applicable conversion rates and transaction fees.

3. Project Pausing & Late Payments

If a client fails to provide the remaining balance or misses a payment plan installment, the project will be paused immediately. Work will resume only after outstanding payments are cleared. Webitt Digital is not liable for any delays or missed deadlines resulting from a paused project due to non-payment.

4. Refund Policy

The 50% deposit is non-refundable as it covers work already commenced. If a project is cancelled after work has begun, a partial refund of the remaining balance may be issued at Webitt Digital's discretion, based on the volume of work completed at the time of cancellation. No refund will be issued for completed work.

5. Revisions

Webitt Digital includes unlimited revisions within the agreed project scope. A revision is a modification to existing approved work. Requests that fall outside the original scope — including new features, additional pages, or significant structural changes — will be treated as new scope and quoted separately.

6. Client Responsibilities

Clients are responsible for providing the following in a timely manner:

• Brand assets including logos, fonts, and brand guidelines
• Written content and copy where applicable
• Images, photography, and media files
• Access to necessary accounts (domain, hosting, third-party services)
• Timely feedback and approvals at each project stage

Webitt Digital may assist with content creation and copywriting as an additional service. Delays caused by the client's failure to provide required materials may affect project timelines. Webitt Digital is not responsible for delays resulting from client-side holdups.

7. Intellectual Property & Ownership

Upon receipt of full and final payment, the client owns all rights to the completed website and its custom-built components. Webitt Digital retains no ownership of the delivered work after final payment.

Webitt Digital reserves the right to display the completed project in its portfolio and marketing materials. The client grants Webitt Digital a non-exclusive, royalty-free license to reference and display the project for promotional purposes.

Any third-party assets, themes, plugins, or licensed software incorporated into the project remain subject to their respective licensing agreements. It is the client's responsibility to maintain applicable licenses after delivery.

8. Hosting Services

Website hosting is available as an optional add-on billed on a monthly basis. Hosting terms and pricing will be outlined in a separate agreement. Webitt Digital is not responsible for third-party hosting provider outages or data loss where hosting is managed by the client.

9. Ongoing Services

Maintenance, SEO, and digital marketing services are offered on a monthly retainer basis. Terms and deliverables are outlined in a separate service agreement. Either party may terminate ongoing services with 30 days written notice.

10. Limitation of Liability

Webitt Digital's total liability for any claim shall not exceed the total amount paid by the client for the relevant project. Webitt Digital is not liable for indirect or consequential damages including loss of revenue, loss of data, or business interruption.

11. Governing Law

These Terms are governed by the laws of Trinidad and Tobago. Any disputes shall be resolved under the jurisdiction of the courts of Trinidad and Tobago.

12. Changes to These Terms

Webitt Digital reserves the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
